Terms and Conditions

These Terms and Conditions govern purchases made through the Toolboks website. They are intended for the sale of physical products to customers in Norway and, where applicable, other EEA countries. Consumers who purchase online are entitled to clear pre-contract information about the trader, the product, the total price including taxes, delivery costs, payment, and cancellation rights.


1. About the seller

These Terms and Conditions of Sale apply to purchases made through the Toolboks website. Toolboks is the product and brand name. The seller of the products offered on this website is:

If ALM Creative AS is registered for Norwegian VAT, VAT information will be stated where required at checkout and on the invoice.


2. Scope of these terms

These Terms and Conditions apply to all orders for physical goods placed through the Toolboks website, unless otherwise agreed in writing.

By placing an order, the customer confirms that they have read and accepted these Terms and Conditions before completing the purchase. These Terms are made available on the website in a clear and accessible manner before the customer places an order.


3. Products

ALM Creative AS sells Toolboks as a physical product. Product descriptions on the website set out the main characteristics of the goods, including what is included in the box and any relevant limitations or variations.

Product images are illustrative. Minor variations in colour, finish, packaging, or printed details may occur due to screen settings, materials, or production processes. Such variations do not affect the essential characteristics of the product and do not constitute a defect.


4. Ordering process and formation of contract

Orders are placed through the website checkout process. The customer must provide complete and accurate information when placing an order.

Before submitting an order, the customer will be shown the total price, including applicable taxes, shipping charges, and any other costs that apply to the order.

A binding purchase agreement is formed when ALM Creative AS accepts the order and sends an order confirmation email to the customer.

The seller may refuse or cancel an order before dispatch for a legitimate reason, including a manifest pricing error, stock unavailability, suspected fraud, payment issues, or other circumstances making fulfilment impossible or unreasonable. If payment has already been received for a cancelled order, the seller will refund the amount paid without undue delay.

The customer is responsible for ensuring that the final checkout action clearly marked as creating an obligation to pay is completed only after reviewing the order details.


5. Prices, taxes, and payment

All prices are stated in NOK and are currently exclusive of Norwegian VAT, as ALM Creative AS is not yet registered for Norwegian VAT. If VAT registration becomes applicable, prices, checkout wording, and invoices will be updated accordingly. For orders shipped outside Norway, any import duties, customs charges, local taxes, VAT, or similar charges imposed by the destination country are the responsibility of the customer unless expressly stated otherwise on the website.

Accepted payment methods are listed at checkout. Payment must be authorised before the order is processed and dispatched.


6. Shipping and delivery

At launch, ALM Creative AS ships within Norway only. International shipping to Europe may be added later. If international shipping is offered in future, the website will clearly state any applicable customs duties, taxes, and delivery conditions before purchase.

Available delivery methods, shipping regions, estimated delivery times, delivery restrictions, and shipping costs are shown at checkout.

Unless another delivery period has been expressly agreed, orders will be delivered within 30 days from the date of the order confirmation.

Delivery times are estimates only and may be affected by circumstances outside the seller’s reasonable control, including carrier delays, customs processing, weather conditions, labour disputes, transport disruption, or force majeure events.

The customer is responsible for providing a correct and complete delivery address. If a parcel is returned because of an incorrect address, failed delivery, or failure to collect the parcel, the seller may require payment of the cost of re-shipment before the order is sent again.

Risk of loss or damage passes to the customer when the goods are delivered to the customer or to a third party designated by the customer, other than the carrier, unless mandatory law provides otherwise.


7. Right of withdrawal for consumers

If the customer is a consumer purchasing online from within Norway or another EEA country, the customer generally has the right to withdraw from the purchase within 14 days without giving any reason.

For goods, the withdrawal period expires 14 days after the day on which the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods. If an order consists of multiple goods delivered separately, the period expires 14 days after receipt of the last item.

The customer may exercise the right of withdrawal by sending a clear statement by email. A model withdrawal text will be made available on the website or in the order confirmation. Until then, the customer may use the following wording:

“I hereby give notice that I withdraw from my purchase of the following goods: [product name], ordered on [date], received on [date], order number [number], customer name [name], customer email [email].”

If the customer validly withdraws from the contract, the customer must return the goods without undue delay and no later than 14 days after notifying the seller of the withdrawal.

The customer may inspect the goods in the same manner as would be possible in a physical shop. The customer is liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

Unless otherwise required by mandatory law, the customer is responsible for the direct cost of return shipping when exercising the right of withdrawal, provided this has been clearly stated before purchase.

If the customer withdraws from the contract, the seller will refund all payments received from the customer, including the cost of the least expensive standard delivery option offered for the order, without undue delay and no later than 14 days after receiving notice of withdrawal. The seller may withhold reimbursement until the goods have been received back or the customer has supplied evidence of having sent back the goods, whichever occurs first.

Refunds will be made using the same payment method used for the original transaction, unless the customer has expressly agreed otherwise and provided that no fees are incurred by the customer as a result of the refund method.

If the seller has not provided the information about the right of withdrawal or a withdrawal form where legally required, the withdrawal period may be extended in accordance with applicable law.


8. Exceptions to the right of withdrawal

The right of withdrawal does not apply where an exception applies under mandatory consumer law. This may include goods made to the customer’s specifications or clearly personalised goods, sealed goods that are not suitable for return for health or hygiene reasons once unsealed, or other categories excluded by law.

If a product is not eligible for withdrawal, this will be clearly stated on the website before purchase.

At present, Toolboks products are not personalised or custom-made, and therefore the right of withdrawal applies unless otherwise stated in the product description for a future product.


9. Defective, damaged, or incorrect goods

The customer must inspect the goods within a reasonable time after delivery.

If the customer receives goods that are damaged in transit, defective, or not the goods ordered, the customer must contact the seller as soon as reasonably possible and include the order number and, where relevant, photographs of the issue.

Nothing in these Terms limits any statutory rights relating to defective or non-conforming goods.

Where required by applicable law, the seller will provide an appropriate remedy, which may include repair, replacement, price reduction, or refund, depending on the circumstances and the customer’s statutory rights.

10. Refunds

Any refund due under these Terms or under applicable law will be made to the original payment method unless otherwise agreed.

The time required for the refunded amount to appear in the customer’s account may depend on the payment service provider or bank and is outside the seller’s control.


11. Intellectual property

All content on the Toolboks website and in Toolboks product materials, including text, branding, logos, graphics, photographs, product descriptions, layout, and design elements, is owned by or licensed to ALM Creative AS and is protected by copyright, trademark, and other applicable intellectual property laws.

No part of the website or product materials may be copied, reproduced, distributed, published, adapted, or used for commercial purposes without the seller’s prior written consent, except where such use is permitted by mandatory law.


12. Limitation of liability

Nothing in these Terms excludes, restricts, or limits any consumer rights or any liability that cannot lawfully be excluded or limited under applicable law.

Subject to mandatory law, the seller is not liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity, or losses arising from circumstances outside the seller’s reasonable control.

The seller does not guarantee that the website will always be uninterrupted, timely, secure, or error-free, but will use reasonable efforts to maintain the availability and functioning of the website.


13. Privacy and website use

Personal data collected during the ordering process will be processed in accordance with the website’s Privacy Policy.

The customer is responsible for using the website lawfully and must not misuse the website, interfere with its functioning, or attempt unauthorised access to any part of the website, related systems, or customer data.


14. Governing law and disputes

These Terms and Conditions are governed by Norwegian law.

If the customer is a consumer resident in another country, mandatory consumer protection laws in the customer’s country of residence may also apply and will prevail where required by law.

If a dispute arises, the customer is encouraged to contact the seller first so that the parties can attempt to resolve the matter amicably.

Consumers may also have the right to bring a complaint before a consumer complaints body, dispute resolution body, or court in accordance with applicable law.


15. Changes to these terms

The seller may update these Terms and Conditions from time to time to reflect changes in the website, the business, or legal requirements.

The version of the Terms published on the website at the time the customer places the order will apply to that order.
